Shall mean the distinctive form of but not limited to the following: Names, signatures, words, works, letters, numerals, designs, architectural designs, drawing, sketches, croqui, pictures, symbols, stamps, seals, vignettes, reliefs and any other sign or a variety of colors, a non-functional single colour, or a combination of signs, if used or intended to be used during the announced design competition or thereafter in any respective field to distinguish goods.
Shall mean or refer to any and all materialized background IP in any physical or numerical form or generated in the framework of the Competition and the competition objectives defined
shall mean the rights deemed to arise when foreground IP are registered as, for instance, patents, copyrights, trademarks or designs.
Shall mean in particularity, architectural, technical drawings related or in connection with the subject of the competition.
shall mean allowing the MP to derive financial reward from the use of Participant works.
Eligible Participant (s), acknowledges that all background intellectual property rights and/or foreground IP rights of whatsoever nature are of the exclusive creation of the Participant , unique and acknowledged the ownership of the Participant and are copyright-free or copyright released and assignable shall they are copyrighted and does not infringe any third party copyrights. No unauthorized use or submission of any copyright work or other material will be accepted or tolerated.
To that end, Participant and copyright(s) infringer, will at all times during or following the closure of the competition, whether the entry was elected winner or not, and must defend and indemnify MSHEIREB MUSEUM and MP from and against any claim, lawsuit, or other proceeding, cost, liability, or expense to the extent arising out of any third party claim that an the entry infringes any patent, copyright, or other intellectual property right of any third party.
In consideration of the accepted entry in respect of the competition, Shall the IP rights are copyrighted or not, Winner Participant hereby grants to MP the exclusive, royalty free irrevocable and perpetual license along all its rights, title and interest in and to the licensed IP Rights.
Such license shall mean MP absolute undisputable right to the economical rights, exploitation, copying, modifying, creating derivative works based upon, selling and displaying any works or products of any kind that are covered by such Related Rights.
Winner Participant hereby grants to MP the irrevocable right to cede, assign and transfer to Third Party, and without requiring permission or notification from the Winner Participant, whatever rights, Title, licenses and interest that MP may have on the participant’s submissions.
Winner Participant hereby irrevocably waives, any economical right, title or interest it may have now or in the future in and to any intellectual property successfully entered in respect of the competition.
Except for the rights granted in the License Grant, Winner Participant shall retain Moral rights in the IP. MP will retain all interest in and ownership of its Intellectual Property existing prior to the competition or developed outside the scope of the competition.
هي الشكل المميِّز للعناصر التالية على سبيل المثال لا الحصر: الأسماء، والتواقيع، والكلمات، والأعمال، والحروف، والأعداد، والتصاميم، والتصاميم المعمارية، والرسوم، والرسوم التخطيطية، والرسوم الأولية، والصور، والرموز، والطوابع، والأختام، والرسوم الإيحائية/الإيضاحية، والزخارف التي تغطي حواف الصور، والنقوش، أو أي علامة أخرى أو أي مجموعة متنوعة من الألوان أو اللون الوحيد غير المميِّز، أو مزيج من العلامات، وذلك في حال استخدامها أو عقد العزم على استخدامها خلال مسابقة التصميم المعلن عنها أو بعدها في أي مجال ذي صلة بهدف تمييز السلع أو البضائع.
هي التي تعني أو تشير إلى أي ملكية فكرية أساسية تكوّنت بأي صيغة مادية أو عددية أو تشكّلت في إطار المسابقة وأهدافها المحددة.
هي الحقوق التي تنشأ عند تسجيل الملكية الفكرية الآجلة على شكل براءات اختراع أو حقوق تأليف ونشر أو علامات تجارية أو تصاميم.
هي التي تعني على وجه الخصوص الرسوم المعمارية والفنية أو تلك المتصلة بموضوع المسابقة.
ويُقصد بها تيسير حصول مشيرب العقارية على منفعة مالية من استخدام أعمال المشاركين.
يقرّ المشارك المؤهل بأن جميع حقوق الملكية الفكرية الأساسية أو حقوق الملكية الفكرية الآجلة، أو كليهما، بجميع صيغها وأشكالها، هي من الإنشاء الحصري للمشارك، وتشكّل ملكيته الفريدة التي يقرّ بها، وغير خاضعة لحقوق التأليف والنشر وتمّ التصريح باستخدامها وأصبحت حقوقًا مملوكة للجهة المنقولة إليها، ولا تنتهك حقوق التأليف والنشر لأي طرف ثالث. ولن يتمّ قبول أي استخدام غير مأذون به لأي عمل أو مادة خاضعة لحقوق التأليف والنشر أو التساهل بشأن ذلك.
وتحقيقًا لهذه الغاية، سيقوم المشارك منتهك حق (حقوق) التأليف والنشر في أي وقت خلال المسابقة أو بعد اختتامها، سواءٌ تمّ اختياره من بين الفائزين أم لا، بالدفاع عن متاحف مشيرب ومشيرب العقارية ضدّ أي مطالبة أو دعوى قضائية أو إجراءات أخرى وتعويض أي تكاليف أو التزامات مالية أو نفقات تنشأ عن أي مطالبة يرفعها طرفٌ ثالث تدّعي أن مشاركَة المشارك المقبولة في المسابقة انتهكت براءة اختراع أو حقوق التأليف والنشر أو أي حق من حقوق الملكية الفكرية الخاصة بالطرف الثالث.
في مقابل قبول المشارك في المسابقة، سواءٌ أكانت حقوق الملكية الفكرية الخاصة بأعماله المقدّمة محمية بحقوق التأليف والنشر أم لا، يمنح المشارك الفائز مشيرب العقارية بموجبه الترخيص الحصري والدائم وغير القابل للإلغاء لحقوق المؤلف وكامل الحق والملكية والمصلحة المتعلقة بحقوق الملكية الفكرية المرخصة.
ويُقصد بهذا الترخيص الحق المطلق غير القابل للمنازعة للحقوق الاقتصادية واستخدام أية أعمال أو منتجات مهما كان نوعها ونسخها وتعديلها وإنشاء أعمال مشتقة منها وبيعها وعرضها، بوصفها مشمولة بحقوق الملكية الفكرية.
وعليه، يمنح المشارك الفائز بموجبه مشيرب العقارية الحق غير القابل للإلغاء بالتنازل والنقل إلى طرف ثالث عن جميع الحقوق والملكية والرخص والمصالح المتعلقة بالأعمال التي قدّمها المشارك ودون الحاجة لإذن أو إشعار منه.
يتنازل المشارك الفائز بموجبه بشكل لا رجعة فيه عن كافة الحقوق الاقتصادية و المصالح الحالية أو المستقبلية المتعلقة بأعماله التي يشارك بها والمقبولة في المسابقة
يحتفظ المشارك بالحقوق المعنوية للملكية الفكرية باستثناء الحقوق الممنوحة بموجب الترخيص الممنوح. وتحتفظ مشيرب العقارية بحيازة الملكية الفكرية والمصالح المتعلقة بها التي كانت قائمة قبل الاشتراك في المسابقة أو نشأت خارج نطاقها.
